These Terms of Service ("Terms") govern your use of the Hearth mobile application ("App") operated by Eternal Mind Labs, LLC ("Hearth," "we," "us," or "our"). By creating an account or using Hearth, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use Hearth. By creating an account, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. If we learn that a user is under 18, we will immediately terminate their account.
You are responsible for keeping your account credentials secure. Do not share your password or allow others to access your account. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us at support@eternalmindlabs.xyz immediately.
You may only create one account. Creating multiple accounts to circumvent a suspension or ban is prohibited.
All Hearth members sign a community pledge committing to show up with honesty, care, and intentionality. This pledge is not merely symbolic — it reflects the standard of behavior we expect. Violating the spirit of the pledge is grounds for removal from a circle or from the platform.
Hearth is built for genuine human connection. The following behaviors are strictly prohibited:
Violation of these standards may result in content removal, suspension, or permanent termination of your account, at our sole discretion.
Circles are small, private groups facilitated by a Creator and optionally a Guardian. Membership is earned — you must apply and be accepted by the existing members. Creators and Guardians have the authority to manage membership and enforce community standards within their circle, including removing members.
We reserve the right to dissolve any circle that violates these Terms or our community standards.
You retain ownership of the content you post on Hearth — including messages, photos, voice recordings, and prompt responses.
By posting content on Hearth, you grant Eternal Mind Labs, LLC a non-exclusive, royalty-free, worldwide license to store, display, and transmit that content solely for the purpose of operating the App. We do not use your content for advertising or sell it to third parties.
You are solely responsible for the content you post. Hearth is not responsible for content posted by other users. If you encounter content that violates these Terms, please report it using the in-app reporting feature.
Voice intros submitted as part of a circle application are shared only with current members of that circle for the purpose of voting on your application. By submitting a voice recording, you consent to it being accessible to those members during the application review period.
Your use of Hearth is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
Hearth may offer a premium subscription tier ("Hearth+") with additional features. Subscription terms, pricing, and billing details will be presented clearly at the time of purchase. Subscriptions are managed through Apple's App Store or Google Play and are subject to their respective billing and refund policies. We do not process payment information directly.
You may delete your account at any time from Profile → Settings → Delete Account in the app. Deletion removes your personal data within 30 days.
We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, if we discontinue the App, or for any other reason at our sole discretion. If we terminate your account without cause, we will provide reasonable notice where possible.
Hearth is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for the conduct of any user on or off the platform.
Hearth facilitates connections between people but does not vet, endorse, or guarantee the identity, safety, or trustworthiness of any user. You assume all risk when meeting other members in person.
To the fullest extent permitted by law, Eternal Mind Labs, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or interactions with other users. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless Eternal Mind Labs, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for violations of intellectual property rights.
You waive the right to participate in class-action lawsuits against Hearth.
If you downloaded Hearth from Apple's App Store, you acknowledge that: (a) these Terms are between you and Eternal Mind Labs, LLC only, not Apple; (b) Apple has no obligation to provide maintenance or support for the App; (c) Apple is not responsible for any claims related to the App; and (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.
We may update these Terms from time to time. When we do, we'll update the "Last updated" date. For material changes, we'll notify you via the App or by email. Continued use of Hearth after changes are posted constitutes your acceptance of the updated Terms.
